TERMS AND CONDITIONS


Nuova Sella Europa


1. Pursuant to art. 5 DL 185/1999, if the customer is a consumer (ie a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to Nuova Sella Europa a reference of Partita VAT), has the right to terminate the purchase contract for any reason, without need to provide explanations and without any penalty, except as indicated in paragraphs 3 and 5 below.

2. To exercise this right, the customer must send Nuova Sella Europa a communication to that effect within ten working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt addressed to:

or by telegram or fax always sent within the aforementioned ten-day term and followed by a confirmation by registered letter with acknowledgment of receipt sent STRICTLY within the following 48 hours. Once we have received the aforementioned withdrawal notice, Nuova Sella Europa will quickly inform the customer of the instructions on how to return the goods, which must be received within ten days of authorization.

The goods must be returned intact, complete with all its parts and in the original packaging (envelopes and packaging), kept and possibly used in the normal diligence, without any signs of wear or dirt, in compliance with the conditions of the following points 3 and 5.

3. The right of withdrawal is subject to the following conditions:
• the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, saddles, etc.);
• the right does not apply to sealed computer software products (including those attached to hardware) once opened;
• the purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...); to limit damage to the original packaging, we recommend, when possible, to put it in a second box; in all cases, the attachment of labels or adhesive tapes directly to the original product packaging should be avoided;
• by law, the shipping costs for returning the goods are charged to the customer; furthermore, the delivery costs to the customer and any other additional costs highlighted at the time of the order will not be reimbursed;
• the shipment, until the certificate of receipt in our warehouse is under the full responsibility of the customer;
• in the event of damage to the goods during transport, Nuova Sella Europa will notify the customer of what happened (within 5 working days from receipt of the goods in its warehouses), to allow it to file a timely complaint against the courier chosen by him and obtain repayment of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
• Nuova Sella Europa is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;
• on arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged, Nuova Sella Europa will deduct from the refund due a percentage, in any case not exceeding 10% of it, as a contribution to the costs of restoration.

4. Without prejudice to any repair costs for proven damage to the original packaging, Nuova Sella Europa will reimburse the customer the full amount already paid, within fourteen days of the return of the goods, by transferring the amount charged to the Card. Credit or Bank Transfer. In the latter case it will be the customer's responsibility to promptly provide the bank details on which to obtain the reimbursement (Cod. ABI - CAB - Current Account of the invoice holder).

5. The right of withdrawal is lost for lack of the essential condition of integrity of the good (packaging and / or its content) in cases where Nuova Sella Europa ascertains:
• non-diligent use of the good that has compromised its integrity or the use of any consumables;
• lack of external and / or internal packaging;
• the absence of integral elements of the product (accessories, cables, manuals, parts, ...);
• damage to the product for reasons other than transportation.

In the event of forfeiture of the right of withdrawal, the goods will remain at the Nuova Sella Europa site available to the Customer for collection at your expense.

Guarantees

6. All products sold by Nuova Sella Europa are covered by the manufacturer's standard warranty and 24-month warranty for lack of conformity, pursuant to Legislative Decree 24/02. To use the warranty, the Customer must keep the invoice (or DDT). The exercise of the Guarantee may include the request for assistance to the Authorized Assistance Centers present in the area and / or follow the methods illustrated in the documentation included in the product packaging.

7. The manufacturer's standard warranty is provided in the manner described in the documentation included in the product packaging. If, as a result of an intervention by an Authorized Service Center, the defect is not covered by the manufacturer's standard warranty, the Customer will be charged for any costs of verification and recovery required by the Authorized Assistance, as well as transport costs, if supported by Nuova Sella Europa.

8. The 24-month warranty pursuant to Legislative Decree 24/02 applies to products that present a lack of conformity, provided that the product itself is used correctly, respecting its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer (a natural person who buys the goods for purposes not related to his professional activity, or makes a purchase without indicating a VAT number in the order form). In the event of a lack of conformity, Nuova Sella Europa will, at no cost to the Customer, restore product conformity by repairing / replacing or reducing the price until the contract is terminated. If, as a result of intervention by an Authorized Service Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 24/02, the Customer will be charged for any costs of verification and recovery required by the Authorized Assistance, as well as the transport costs if incurred by Nuova Sella Europa.

9. Substitutions in case of DOA (Dead On Arrival: product not working on delivery) take place only if expressly provided by the manufacturer. The timing of replacement or repair of the product depends solely on the policies of the manufacturer.

10. In the event that, for any reason, it is unable to provide its customer with a product under warranty (restored or replaced), Nuova Sella Europa may proceed at its own discretion to refund the amount paid, taking into account the use of the well or to replace it with a product of equal or superior characteristics.

11. The timing of repair or replacement of the product depends exclusively on the policies of the manufacturer and no damage can be requested from Nuova Sella Europa for any delays in repairs or replacements.

12.In cases where the application of the guarantees involves the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.). ..); to limit damage to the original packaging, we recommend inserting it in a second box; in all cases, the attachment of labels or adhesive tapes directly to the original product packaging should be avoided.

Approval

13.The seller declares that all the products present in the catalog and marketed are in conformity with the standards and homologated according to the European Community standards. The seller is not liable in the event of any discrepancy with the standards of countries that are not members of the European Community and / or their failure to approve the products themselves in the said countries.

Privacy

14. The personal data requested at the time of placing the order are collected and processed in order to satisfy the express requests of the Customer and will in no case and in no way be transferred to third parties. Nuova Sella Europa guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code pursuant to Legislative Decree 196 of 30.06.03. The data controller is Nuova Sella Europa, Via Pomigliano 6 - 80048 - Sant'Anastasia - Naples.

Complaints


15. Any complaint must be addressed to Nuova Sella Europa, Via Pomigliano 6 - 80048 - Sant'Anastasia - Naples.

Applicable law


16. The sales contract between the customer and Nuova Sella Europa, is concluded in Italy and regulated by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial competence is that of the reference hole of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Naples
